TERMS AND CONDITIONS

1. About SCCL and these Terms

Shriram Credit Company Limited ("SCCL", "the Company", "we", "us" or "our") is a Non-Banking Financial Company (Non-Deposit Taking) incorporated under the Companies Act, 1956 (CIN: U65993TN1980PLC008215) and registered with the Reserve Bank of India ("RBI"), having its registered office at Shriram House, No.-4, Burkit Road, T. Nagar, Chennai – 600 017, Tamil Nadu, India. SCCL is the Regulated Entity ("RE") that approves, sanctions and disburses loans offered on the Platform.

These Terms & Conditions ("Terms") govern your access to and use of SCCL's website https://www.shriramcredit.in and its digital lending applications (together, the "Platform"), and your availing of the Loan Against Mutual Funds facility and related services (the "Services"). These Terms are to be read together with the Privacy Policy, the product-specific Key Facts Statement (KFS), the sanction letter and the loan agreement executed with you, and the Schedule of Charges. If there is any conflict, the loan agreement and KFS applicable to your specific loan will prevail for that loan to the extent of any inconsistency relating to the specific terms of that loan, and these Terms shall continue to govern your use of the Platform and Services.

Browsing the general, informational areas of our website is governed by these Terms only to the extent they concern website use — such as intellectual property, disclaimers and permitted use. Merely accessing or browsing the website is not, by itself, treated as your acceptance of the lending terms or as your consent to the processing of your personal data.

Availing the Services, and our collection and processing of your personal data for that purpose, require your explicit consent through an affirmative action — completing registration and/or confirming through a One-Time Password ("OTP") sent to your registered mobile number or e-mail. Where consent is required under Applicable Law, such consent shall be obtained through an affirmative action and may be recorded and maintained by SCCL. Where the collection, use or processing of personal data is permitted or required under Applicable Law without consent, including for compliance with legal or regulatory obligations, KYC/AML requirements, fraud prevention, risk management, SCCL may process such personal data to the extent permitted by Applicable Law. Your acceptance is then recorded and preserved as an electronic record under the Information Technology Act, 2000 and other Applicable Law. If you do not agree, please do not register for or avail the Services.

Please read the terms contained herein carefully to ensure that you understand each provision. If, for any reason, we believe you have not complied with these Terms, we may, at our sole discretion, cancel or restrict your access to all or part of the website, immediately and without prior notice to the extent permitted under Applicable Law.

2. Key definitions

  • "Borrower / You / Your" means the individual availing or intending to avail the Services.
  • "LAMF" means the Loan Against Mutual Funds facility, a secured credit facility under which units of eligible mutual fund schemes held by you are lien-marked as collateral in favour of SCCL.
  • "Lending Service Provider (LSP) / Digital Lending App (DLA)" has the meaning given under the RBI Digital Lending Directions and refers to the agents and digital applications engaged by SCCL for onboarding, servicing, collection or related functions, as listed on our Partners page.
  • "KFS" means the Key Facts Statement issued to you before execution of the loan, in the standardised format prescribed by RBI, containing the Annual Percentage Rate (APR), amortisation schedule, cooling-off / look-up period, and recovery and grievance-redressal details.
  • "RTA" means the Registrar and Transfer Agent (CAMS and KFIN via MF Central) lien-marking of your mutual fund units.
  • "Applicable Law" means all laws, rules, regulations, directions and guidelines in force in India, including the RBI Digital Lending Directions, the RBI KFS circular, the KYC Master Direction, the Prevention of Money Laundering Act, 2002 ("PMLA"), the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023 and rules thereunder in each case to the extent applicable and in force from time to time including any amendments, re-enactments, subordinate legislation, notifications, circulars, directions or guidelines issued thereunder.

3. Eligibility

By using the Platform and applying for the Services, you represent and warrant that you:

  • are a resident of India and a natural person who has attained 18 years of age and is competent to contract under Indian law;
  • have no insolvency proceedings pending against you and have not at any time been adjudicated insolvent by any court or other competent authority;
  • are the sole and lawful holder of the mutual fund units proposed to be pledged, and such units are free from any prior lien, charge or encumbrance and you have full authority to create the lien / pledge in favour of SCCL;
  • are not a person barred or disqualified from availing the Services under Applicable Law or SCCL policy; and
  • will provide true, correct, complete and up-to-date information, and update SCCL promptly (and in any event within 30 days) of any change to your KYC details, contact details or bank details.

The Platform and Services are intended only for persons who have attained 18 years of age. If SCCL becomes aware that a minor has accessed the Platform or that Personal Data of a minor has been inadvertently collected, SCCL will take reasonable steps to close the relevant access and delete such data, save to the extent retention is required under Applicable Law. A parent or guardian who believes their child's data has been inadvertently collected may contact the Grievance Redressal Officer under Section 14 to request deletion.

You authorise SCCL to verify and independently validate any information, declaration, document or representation provided by you from such sources as SCCL may reasonably consider appropriate. SCCL may require additional information or documents at any time for KYC, credit assessment, risk management, fraud prevention, servicing or regulatory purposes.

SCCL may, at its sole discretion and subject to Applicable Law, accept or reject any application, and its decision shall be final.

4. The LAMF facility

LAMF is a secured credit facility offered as a non-revolving overdraft. You pledge eligible mutual fund units as collateral, and SCCL sanctions a credit limit against them. Key features you should note:

  • Interest is charged only on the amount you actually draw down / utilise, not on the full sanctioned limit, at the rate set out in your KFS and loan agreement.
  • The facility is non-revolving: amounts repaid may not be re-drawn unless SCCL expressly permits. Pricing is determined by SCCL's Board-approved risk-based pricing framework.
  • The eligible schemes, loan-to-value (LTV) ratios, minimum and maximum limits, and margin requirements are determined by SCCL in accordance with its Board-approved policy and Applicable Law, and may be revised prospectively.
  • Lien-marking of your units is effected through the relevant MF Central. Until the facility is fully repaid and closed, the pledged units cannot be redeemed, switched or transferred by you except with SCCL's prior consent or as otherwise permitted under the Loan Documents.
  • Disbursement of the loan and your repayments are routed directly between your bank account and SCCL's bank account, and not through the account of any LSP or other intermediary.
  • SCCL will not increase your sanctioned credit limit, or trigger an automatic drawdown, without your explicit consent.
  • Margin monitoring, margin call and invocation. SCCL monitors the value of your pledged units on an ongoing basis. If the value falls below the required threshold (for example due to a fall in NAV), SCCL may call upon you to repay part of the outstanding, pledge additional units, or otherwise restore the required margin within the time specified. If you do not, SCCL may, after due notice and in accordance with the loan agreement and Applicable Law, invoke the pledge and sell / redeem sufficient units to restore the position or recover its dues. If you fail to comply within the applicable period, or where immediate action is otherwise permitted under the loan agreement or Applicable Law, SCCL may, after giving such prior notice as may be required under the loan agreement and Applicable Law, invoke the pledge and sell, redeem, transfer or otherwise realise sufficient units to restore the required margin and/or recover any amounts due to SCCL. The timing, manner, quantity and selection of units to be realised shall be determined in accordance with the loan documents and Applicable Law and SCCL shall be entitled to exercise its rights and remedies in accordance with the Loan Documents and Applicable Law.

SCCL will publish and keep updated, on the Platform and/or the Partners page, an indicative list of mutual fund schemes approved for pledging under the LAMF facility. Subject to the loan documents and Applicable Law, you may request partial release (de-pledge) of pledged units where your outstanding utilisation and required margin permit, or replace one or more pledged schemes with other eligible units (top-up/substitution), through the process described on the Platform; such requests are subject to SCCL's verification and the applicable RTA's processing timelines.

5. Lending Service Providers and Digital Lending Apps

SCCL engages Lending Service Providers and offers the Services through Digital Lending Apps. In accordance with the RBI Digital Lending Directions, the list of LSPs and DLAs engaged by SCCL is published and kept updated on our Partners page at https://www.shriramcredit.in/our-partners. You are encouraged to review that page. SCCL remains responsible, as the Regulated Entity, for the conduct of its LSPs in respect of the Services to the extent required under Applicable Law.

6. KYC, execution and consents

The consents and authorisations below are presented to you in the digital journey and are accepted together by a single affirmative action — completing registration and confirming the One-Time Password (OTP) sent to your registered mobile number or e-mail. They are itemised so that your consent is specific and informed.

Each acceptance, and any later withdrawal, is logged with a timestamp and the version of these Terms. In these clauses, "I", "me" and "my" refer to you, the applicant.

I authorise and give my consent to SCCL to complete my KYC through Video-based Customer Identification Process (V-CIP), as an alternative permitted under the RBI KYC Master Direction, where I opt for or am offered this mode. I understand that V-CIP will involve live capture of my photograph together with GPS geo-tagging and a date/time stamp, and capture of my PAN and other Officially Valid Documents during the video interaction, and that the video recording of this interaction will be retained by SCCL in accordance with Applicable Law. I understand that if my V-CIP session is incomplete, or if the details captured do not match my submitted documents, SCCL may, at its discretion, require me to complete physical KYC or reject my application for the affected Financial Product.
  • 6.5 PAN validation. I authorise and give my consent to SCCL to verify, check, obtain and update my PAN details from / with the relevant issuing / verification authority (including Protean eGov Technologies Limited and / or the Income Tax Department).

Any withdrawal of consent shall not affect processing, reporting or retention that SCCL is required or otherwise permitted to undertake under Applicable Law.
  • 6.6A Credit bureau and employment verification. I understand that the credit information companies / bureaus referred to above include, without limitation, TransUnion CIBIL Limited, Experian, Equifax and CRIF High Mark, and I separately authorise SCCL to verify my employment and income details with my employer or through third-party verification services, for the purposes set out above.

  • 6.9 Auto-debit mandate (e-NACH / NACH). I authorise SCCL to set up and present an electronic mandate (e-NACH / NACH) on my designated bank account for auto-debit of interest, instalments and other amounts due under the Financial Products, in accordance with the mandate registered by me.
  • 6.10 Marketing (separate, optional). Separately, and only if I opt in, I consent to receive promotional and marketing communications from SCCL and its group companies. I understand this consent is optional, is not required to avail the Services, and can be withdrawn at any time.
  • 6.11 Confirmation. I confirm that all information and documents provided by me are true, correct and up to date, that I have not withheld any material information, and that I shall promptly — and in any event within 30 days — update SCCL of any change to my KYC / CKYC details, bank details or address.

How your information is collected, used, shared, retained and protected is set out in the Privacy Policy. You may withdraw these consents as described in Section 12 to the extent such withdrawal is legally available and does not affect processing that SCCL is required or otherwise permitted to undertake under Applicable Law.

7. Key Facts Statement, APR and cooling-off period

Before you execute the loan, SCCL will provide you with a Key Facts Statement (KFS) in the RBI-prescribed standardised format, carrying a unique proposal number and a validity period. The KFS sets out the all-inclusive Annual Percentage Rate (APR), the computation sheet, the amortisation schedule, all fees and charges, the cooling-off / look-up period, and the recovery and grievance-redressal mechanism. The contents of the KFS will be explained to you and your acknowledgement recorded. The KFS is also annexed, as a summary, to your loan agreement. SCCL will not levy any charge that is not disclosed in your KFS except to the extent expressly permitted under Applicable Law and the applicable loan documentation.

During the cooling-off / look-up period stated in your KFS, you may exit the loan by repaying the principal and the proportionate APR, without any penalty (other than, where applicable, non-refundable processing charges disclosed in the KFS).

8. Fees, charges, repayment and recovery

  • The fees and charges applicable to the Services are as set out in your KFS, loan agreement and the Schedule of Charges published on the Platform, and may be revised prospectively with notice as required by Applicable Law. SCCL will not levy any charge that is not disclosed in your KFS except where such charge is expressly permitted under Applicable Law and applicable contractual documentation.
  • Repayments and recoveries are appropriated in the order set out in your loan agreement (generally Charges, then Interest, then Principal). Interest accrues and is debited as specified in the KFS / loan agreement.
  • Penal charges for default or non-compliance, if any, are levied as reasonable charges (and not as penal interest capitalised into the loan) and are disclosed in your KFS and loan agreement in accordance with Applicable Law.
  • Prepayment and foreclosure terms are as set out in your KFS and loan agreement.
  • You are responsible for maintaining a valid auto-debit mandate (e-NACH / NACH) where applicable and for ensuring sufficient funds and for ensuring that the mandate remains valid and capable of being presented for amounts lawfully due and payable.
  • Collections and recovery. SCCL and its authorised recovery agents will engage with you fairly and respectfully, in accordance with the RBI directions and SCCL's Board-approved Collections & Recovery policy. Where a recovery agent is assigned to your account, the agent's details will be communicated to you.
  • Where a payment made by you through the Platform's payment gateway is debited more than once for the same instalment due to a technical error, or where an amount is erroneously debited in excess of what is due, you may write to SCCL with the transaction reference and payment proof; SCCL will investigate and, where the claim is validated, refund the excess amount to the original payment method within a reasonable time in accordance with Applicable Law and the payment gateway provider's processes.

9. Right of lien and set-off

In addition to the pledge over your mutual fund units, and subject to Applicable Law, you grant SCCL a right of lien and set-off. SCCL may, with due notice to you, appropriate or adjust any monies belonging to you and available with SCCL towards any amounts due and payable by you under the Services, including any charges, fees or dues, and towards recovery of funds relating to any transaction that is erroneously or mistakenly processed. Such right of lien and set-off shall be in addition to, and shall not prejudice, any other right, remedy, security or power available to SCCL under the loan documents or Applicable Law.

10. Your account and security of credentials

You are responsible for maintaining the confidentiality and security of your account, password, PIN, OTP and login credentials, and for all activity under your account. Notify SCCL immediately if you suspect any unauthorised access. SCCL uses industry-standard security procedures, including OTP-based authentication, but is not liable for loss arising from your failure to safeguard your credentials.

You may register and maintain only one active account on the Platform in your name. If SCCL identifies multiple or duplicate accounts held by you, it may, at its discretion, consolidate, suspend or close the duplicate account(s), without prejudice to your obligations in respect of any Services already availed.

11. Communications and consent

By accepting these Terms, you consent to being contacted by SCCL, its group companies, LSPs and authorised partners in connection with your onboarding, loan, servicing and recovery, through telephone calls, SMS, WhatsApp, e-mail, push notifications and other electronic means. Certain communications (such as repayment reminders, KFS, sanction and account-related notices) are service-related and will be sent even where you have opted out of marketing communications.

You may opt out of promotional / marketing communications at any time using the unsubscribe facility by writing to us. You may withdraw consents given for optional data access (e.g. device permissions) through your device settings or as described in the Privacy Policy; withdrawal may affect your ability to avail or continue the Services.

You are responsible for ensuring that your registered mobile number, e-mail address and other contact details remain current. Communications sent by SCCL to your registered contact details shall, subject to Applicable Law and the applicable loan documents, be deemed duly communicated to you in accordance with the applicable notice provisions.

12. Withdrawal of consent and closure

You may withdraw any consent you have given, at any time, through the in-app privacy settings on the Platform (which are at least as easy to use as the means by which you gave consent), or by writing to us at [privacy / grievance e-mail - grievanceredressal@shriramcredit.in]. On withdrawal you may also request that SCCL delete or "forget" your data to the extent such right is available under Applicable Law.

Withdrawal is prospective and does not affect processing already carried out, or processing SCCL is required to continue under Applicable Law (including KYC and record-retention obligations under the RBI directions and the PML Act, 2002) or to service and recover a subsisting loan. Withdrawing consent for information essential to the Services may prevent SCCL from providing or continuing them; SCCL will inform you of such implications. All consent and withdrawal actions are securely logged.

For the avoidance of doubt, withdrawal of consent shall not by itself constitute termination, cancellation, waiver or discharge of any loan, security, repayment obligation or other contractual obligation of the Borrower, and shall not prejudice any rights or remedies available to SCCL under the applicable loan documents or Applicable Law.

13. Your obligations and prohibited uses

You agree not to use the Platform for any unlawful or fraudulent purpose, and in particular not to:

You agree to indemnify and hold harmless SCCL, its group companies, officers, directors, employees and authorised partners from and against any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your use of the Services, your breach of these Terms, your violation of any third-party right, or your non-compliance with Applicable Law or arising from any fraud, wilful misconduct, misrepresentation, inaccurate or incomplete information, misuse of the Platform, unauthorised use of your account or credentials attributable to you.

17. Suspension and termination
